These Terms & Conditions (“Terms”) govern your use of the Golden Gate Concierge Nursing, P.C. (“Company,” “we,” “our,” or “us”) website, online forms, communications, and any concierge nursing services coordinated through our practice.

By accessing our website or requesting services, you agree to be bound by these Terms.

If you do not agree, you must discontinue use immediately.



1. Description of Services

Golden Gate Concierge Nursing, P.C. is a professional corporation that coordinates private-duty and concierge nursing services. All hands-on care is delivered by independent contractor Registered Nurses, who are not employees of the Company.

We do not provide:

  • Medical diagnosis
  • Medical treatment
  • Emergency medical care
  • Home health agency services
  • Physician-level services

Your assigned Registered Nurse exercises independent clinical judgment and is individually responsible for their own HIPAA, CMIA, and licensing compliance.



2. Eligibility for Services

To request services, you must:

  • Be at least 18 years old or have a legal guardian engaged in the process
  • Provide accurate and complete intake information
  • Maintain a safe, non-threatening environment for in-home care
  • Maintain an active payment method on file

We may decline requests when services are not clinically or operationally appropriate.



3. Independent Contractor Nurses

All nurses coordinated through the Company are independent contractors, not employees.

Nurses may:

  • Accept or decline assignments
  • Modify care plans as clinically appropriate
  • Discontinue services for safety or scope-of-practice reasons

The Company is not liable for a nurse’s independent clinical decisions or professional actions.



4. Scheduling & Service Requests

Scheduling is based on nurse availability and the clinical appropriateness of the request.

We do not guarantee availability for specific times, dates, or nurse preferences.

Urgent, emergent, or last-minute requests may not be accommodated.



5. Payment Terms

Clients agree to maintain valid payment information and authorize the Company to charge for:

  • Nursing services
  • Cancellations within the stated window
  • Additional hours requested by the client
  • Travel or concierge fees, if applicable

Failure to maintain an active payment method may result in immediate discontinuation of services.



6. Cancellations & Rescheduling

Cancellation windows may vary depending on the nurse and service type.

Late cancellations or requests to shorten an already-booked shift may incur fees.

We may reschedule services due to:

  • Nurse unavailability
  • Illness
  • Safety concerns
  • Natural disasters or emergencies



7. Client Responsibilities

You agree to:

  • Provide a safe home environment
  • Follow reasonable nurse instructions regarding safety or infection control
  • Refrain from harassment, threats, or inappropriate behavior
  • Disclose accurate medical information needed for care coordination
  • Not request services outside the nurse’s legal scope of practice



8. Non-Emergency Care Notice

Golden Gate Concierge Nursing does not provide emergency medical services.

If you experience a medical emergency, call 911 immediately.



9. Safety Requirements for In-Home Care

Services may not be provided in environments with:

  • Violence or threats
  • Intoxicated individuals
  • Hoarding or hazardous conditions
  • Illegal activity
  • Severe pest infestations
  • Fire, electrical, or structural dangers

Nurses may leave immediately if safety is compromised.



10. Prohibited Conduct

Clients and household members may not:

  • Use abusive, harassing, or threatening language
  • Interfere with a nurse’s clinical judgment
  • Request narcotics, controlled substances, or prohibited procedures
  • Record nurses without explicit consent
  • Request services outside legal scope



11. Right to Refuse or Discontinue Service:

Golden Gate Concierge Nursing, P.C. reserves the right to decline, refuse, or discontinue service at our discretion, for any lawful and non-discriminatory reason.

Where nursing services have already begun, discontinuation will occur with reasonable notice and in a manner consistent with avoiding patient abandonment or creating unacceptable clinical risk.

Examples of lawful reasons for denial or discontinuation include, but are not limited to:

  • Unsafe or hostile environments
  • Repeated boundary violations
  • Non-payment or chargebacks
  • Requests that exceed scope of practice
  • Interference with a nurse’s independent clinical judgment
  • Misrepresentation of medical or personal information
  • Inability to provide an appropriate nurse for the requested care

We may deny service at any time before care begins without further explanation.



12. Privacy & Use of Personal Information:

Your data is handled according to our Privacy Policy & Notice of Privacy Practices, compliant with CPRA, CMIA, and HIPAA (where applicable).

By using our services, you acknowledge and agree to our Privacy Policy.



13. Limitation of Liability:

To the maximum extent permitted by law, the Company is not liable for:

  • Independent contractor nurse actions
  • Client misuse of medical guidance
  • Consequences of inaccurate or incomplete information provided by the client
  • Losses arising from circumstances outside our control

Your sole remedy for dissatisfaction is discontinuing use of our services.



14. Indemnification:

You agree to indemnify and hold harmless the Company and its contractors from claims arising out of:

  • Misuse of services
  • Violations of these Terms
  • Unsafe environments or conditions
  • Intentional misconduct or negligence by the client



15. Governing Law:

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.



16. Dispute Resolution & Arbitration:

Any dispute arising from these Terms or the services provided shall be resolved through binding arbitration in California. You waive your right to a jury trial.



17. Changes to These Terms:

We may update these Terms periodically. The revised version becomes effective upon posting with an updated Effective Date.

Continued use of the website or services constitutes acceptance of the revised Terms.
